Section 3-122-111 - Notice of intent to offer(a) When required by the solicitation, a prospective offeror shall file a notice of intent to offer, subject to the following: (1) The notice shall be received not less than ten days prior to the deadline for receipt of offers; and(2) The notice may be submitted by facsimile or electronically, pursuant to section 3-122-9, and the date of receipt as evidenced by the time indicated on the electronic transmittal or the procurement officer's transaction receiving report, shall determine timeliness of the notice.(b) A notice of intent to offer may be waived in the case of a single offer when the procurement officer determines that acceptance is in the best interest of the public and the basis for the acceptance is explained in the written determination.[Eff and comp MAR 21 2008] (Auth: HRS §§ 103D-202, 103D-310) (Imp: HRS § 103D-310)
