Section 17-1722-58 - Eligibility requirements(a) Members of this group must have been eligible for SHIP as of July 31, 1994 and would have maintained continued eligibility except for the discontinuance of SHIP, and were not eligible for inclusion in the formerly known QUEST program as of August 1, 1994.(b) A member of this group shall: (1) Be a resident of the State who is a citizen of the United States or a legal resident non - citizen;(2) Not be entitled to benefits under the Medicaid program with the exception of those whose eligibility is dependent on a spenddown of income;(3) Not be entitled to insurance benefits under the Medicare program;(4) Not be entitled to coverage under TRICARE or another federally sponsored program except for benefits under the Native Hawaiian Health Care Act of 1988;(5) Not be entitled for insurance benefits under the Hawaii Prepaid Health Care Act; and(6) Not have income exceeding three hundred percent of the FPL.(c) An exception to subparagraph (b)(6) are state emergency appointments and their families who are ineligible for health insurance coverage through the employer.(d) Any break in eligibility shall cause permanent exclusion from this group.
