Section 7270 - Application Process and Other General Requirements(a) Any individual wishing to apply for the nonvocational services for the blind specified in this article may do so orally or in writing at the Department's district or branch office closest to his/her place of residence. The individual shall be required to supply only such limited documentation as necessary for the Counselor to establish eligibility and the amount and type of services to be provided.(b) The Counselor shall: (1) Fully explain the provisions of this article to individuals requesting nonvocational services for the blind.(2) Promptly determine an individual's eligibility and the amount and type of services to be provided, but in no instance later than 45 days from the receipt of his/her application in the district or branch office.(3) Promptly notify the individual in a communication medium, such as large print, braille or recording, appropriate to his/her needs of any decision to approve, deny or terminate services or change the amount and type of services provided under this article. Notices to deny, terminate or reduce services shall include all of the following: (A) The reason the action is being taken.(B) The legal or regulatory citation supporting the action.(C) An explanation of the individual's appeal rights.(c) In addition to the provisions of this article, the following regulations shall apply to nonvocational services for the blind: (1) Sections 7120 and 7123 through 7125 regarding case records. The content of the case record shall include, but not be limited to, documentation supporting both of the following: (A) That the provisions of this article have been fully explained to the individual.(B) Decisions regarding eligibility for, and/or the amount and type of, services to be received. This shall include copies of the notices sent in accordance with (b).(2) Sections 7140 through 7143.5 regarding confidentiality, to the extent that those sections apply to the limited information that this article requires to be collected.(3) Sections 7350 through 7361 regarding administrative review and fair hearing procedures.Cal.
