Section 1864.3 - Evidence of Use -Determination by Executive Officer If Favorable; Otherwise by BoardThe Executive Officer may determine that the site has been so used if he determines the evidence warrants the same, for the following:
(A) Where the district furnishes evidence of use within the meaning of Section 1864.1(4) A or B above,(B) Where the district furnishes evidence that a school site has been utilized for one-half or more of the number of days in a year by a school district or by any other governmental entity pursuant to agreement with the school district for school or community playground, playing field, or other outdoor recreational purposes. Otherwise, he shall submit the question of use or non-use to the Board for its determination.
