An "in-state processor" is a firm which possesses, or will possess at the time of delivery of royalty oil, gas, or associated substances, the ability to process crude oil, gas, or associated substances into refined petroleum products at a processing facility owned by it in the state. Additional requirements for inclusion in this class will, in the commissioner's discretion, be prescribed for each disposal of royalty oil, gas, or associated substances in the invitation to bid for that disposal.
