Proposed rule.

SUMMARY:

The Environmental Protection Agency (EPA) is proposing under the Clean Air Act to approve a revision to the Arizona Statutes portion of the Arizona State Implementation Plan (SIP). This revision concerns particulate matter (PM) emissions from dust generating operations that do not already have a permit within the Phoenix Planning area. We are proposing to approve a state statute that requires the Arizona Department of Environmental Quality to develop and adopt a general permit that specifies episodic best management practices that are to be implemented by certain dust-generating activities.

SUPPLEMENTARY INFORMATION:

This proposal addresses the following state statute: A.R.S. section 49-457.05 (only A, B, D, and I), (“dust action general permit; best management practices; applicability; definitions”). In the Rules and Regulations section of this Federal Register, we are approving this state statute in a direct final action without prior proposal because we believe this SIP revision is not controversial. If we receive adverse comments, however, we will publish a timely withdrawal of the direct final rule and address the comments in subsequent action based on this proposed rule.

We do not plan to open a second comment period, so anyone interested in commenting should do so at this time. If we do not receive adverse comments, no further activity is planned. For further information, please see the direct final action.
