Slip Op. 50926[U], *4, 2011 WL 2084184) this Court declined to stay the New York action against a guarantor in deference to the mortgage foreclosure action against the borrower in Pennsylvania because the borrower had filed for bankruptcy and the foreclosure action was therefore stayed, in prejudice to the plaintiff lender.
