Opinion

No. 2D16–3631.

Helen K. TIDWELL, Appellant/Petitioner(s), v. STATE of Florida, Appellee/Respondent(s).

BY ORDER OF THE COURT.

Because this petition seeks belated appeal of an order denying a petition for writ of mandamus, the petition for belated appeal is denied. See Powell v. Fla. Dep't of Corr., 727 So.2d 1103 (Fla. 1st DCA 1999) (stating that because the mandamus proceedings below were civil in nature, the provisions of Florida Rule of Appellate Procedure 9.141(c) are not applicable). This disposition is without prejudice to petitioner's right to seek relief in the circuit court by a motion for relief from judgment pursuant to Florida Rule of Civil Procedure 1.540(b).

NORTHCUTT, LaROSE, and SLEET, JJ., Concur.
