In the MATTER OF Cary J. FRIEZE, An Attorney At Law (Attorney No. 282181972)


ORDER The Disciplinary Review Board having filed with the Court its decision in DRB 20-226, concluding that as a matter of final discipline pursuant to Rule 1:20-13(c), Cary J. Frieze of Morristown, who was admitted to the bar of this State in 1972, should be censured based on his conviction in the Hanover Municipal Court following a plea of guilty to disorderly persons shoplifting, in violation of N.J.S.A. 2C:20-11(b)(1), conduct that violates RPC 8.4(b) (commission of a criminal act that reflects adversely on a lawyer's honesty, trustworthiness or fitness as a lawyer in other respects);

And the Disciplinary Review Board having further concluded that Cary J. Frieze should be required to provide proof of his fitness to practice law and receive psychological counseling and provide the Office of Attorney Ethics with proof of his attendance for a period of two years;

And good cause appearing;

It is ORDERED that Cary J. Frieze is hereby censured; and it is further

ORDERED that Cary J. Frieze shall provide proof of his fitness to practice law as attested to by a mental health professional approved by the Office of Attorney Ethics within sixty days after the filing date of this Order; and it is further

ORDERED that Cary J. Frieze shall receive psychological counseling and submit quarterly reports documenting his ongoing counseling to the Office of Attorney Ethics for a period of two years and until the further Order of the Court; and it is further

ORDERED that the entire record of this matter be made a permanent part of respondent's file as an attorney at law of this State; and it is further

ORDERED that respondent reimburse the Disciplinary Oversight Committee for appropriate administrative costs and actual expenses incurred in the prosecution of this matter, as provided in Rule 1:20-17.
