Case 21–RD–2472 September 25, 1992 ORDER AFFIRMING DISMISSAL BY MEMBERS DEVANEY, OVIATT, AND RAUDABAUGH The Board has delegated its authority in this pro- ceeding to a three-member panel, which has considered the Petitioner’s request for review of the Regional Di- rector’s administrative dismissal of the instant peti- tion.1 The request for review is denied as it raises no substantial issues warranting reversal of the Regional Director’s action. Accordingly, the Regional Director’s dismissal of the petition is affirmed. APPENDIX As a result of the investigation, it does not appear that fur- ther proceedings on the petition are warranted inasmuch as the Petitioner seeks a decertification election in a unit con- sisting only of the merchandise employees and merchandise marker employees employed by the Employer, and the cur- rently recognized unit consists of a facilitywide unit of the employees as set forth in the current multiunion agreement. As a decertification election must be held in a unit that is coextensive with the recognized contractual bargaining unit, I am dismissing the petition in this matter.
