The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 36 ballots cast for, and 34 ballots cast against the Petitioner, with 1 challenged ballot, an insufficient number to affect the results. No exceptions have been filed to the hearing officer's report within the time provided. Accordingly, the Board adopts the hearing officer's findings and recommendations, and finds that a certification of representative should be issued.1 1 The Hearing Officer recommended overruling the Employer’s objections 1, 2, and 4. CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for International Brotherhood of Teamsters, Local Union 166 and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: Included: All full-time and regular part-time dedicated drivers and hostlers working at or out of the Employer's operation located at 14900 Innovation Drive, Riverside, California. Excluded: All other employees, including dispatch employees, plant office clericals, business office clericals, warehouse workers, professional employees, temporary and casual employees, managers guards and supervisors as defined by the Act.
