R-616 and C-555 SUPPLEMENTAL DECISION AND ORDER September 29, 1939 On December 3, 1938, the National Labor Relations Board issued a Decision, Order, and Direction of Election in the above-entitled proceeding., On December 10, 1938, the National Labor Relations Board issued an Amendment, and on March 10, 1939, a Second Amendment to the above Direction of Election.2 The Second Amend- Inent to the Direction of Election provided that an election by secret ballot be conducted within forty-five (45) days from the date of the Second Amendment to Direction of Election among all the employees of Pulaski Veneer Corporation, who were em- ployed during the pay-roll period next preceding the date of the issuance of the Second Amendment to Direction of Election, exclud- ing supervisory, clerical, and office employees and those who quit or were discharged for cause between such date and the date of election, to determine whether or not they desire to be represented by United Brotherhood of Carpenters and Joiners of America, Local Union #1862, for the purposes of collective bargaining. Pursuant to the Second Amendment to Direction of Election an election by secret ballot was conducted on April 21, 1939, at Pulaski, Virginia, under the direction and supervision of the Regional Director for the Fifth Region (Baltimore, Maryland). On April 24, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions, Series 1, as amended, issued and duly served upon the parties to the proceeding his Intermediate Report upon the secret ballot. On April 29, 1939, United Brotherhood of Carpenters & Joiners of America, Local Union #1862 filed its protest to the conduct of the election, and on August 31, 1939, it requested withdrawal of said 110 N. No other objections or exceptions to the Intermediate Report have been filed. As to the results of the secret ballot, the Regional Director re- ported as follows : Total number eligible-------------------------------------- 324 Total ballots cast------------------------------------------- 300 Total number of blank ballots -------------------------------- 0 Total number of void ballots-------------------------------- 0 Total number of challenged votes---------------------------- Total number of ballots cast for United Brotherhood of Car- 14 penters & Joiners of America, Local Union #1862---------- 125 Total number of ballots against United Brotherhood of Car- penters & Joiners of America, Local Union #1862-------- 161 The results of the election show that no collective bargaining repre- sentative has been selected by a majority of the employees. The petition for investigation and certification of representatives of United Brotherhood of Carpenters and Joiners of America, Local Union #1862, will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of Na- tional Labor Relations Board Rules and Regulations-Series 2, IT IS HEREBY ORDERED that the petition for investigation and cer- tification of representatives of United Brotherhood of Carpenters and Joiners of America, Local Union #1862, be, and it hereby is, dismissed.
