Case No. R-1395 CERTIFICATION OF REPRESENTATIVES September $9,1939 On August 23, 1939, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding., On August 31, 1939, the Board issued an Amendment to Direction of Election.2 The -Direction of Election, as amended, directed that an election by secret ballot be conducted within :twenty-two (22) days from.tlie'date of the Direction among the production employees of Minneapolis-Moline Power Implement Company at its Hopkins, Minnesota, plant whose names appear on its pay roll at any time between December 10, 1938, and the pay- roll period immediately preceding the date of the Direction of Election, inclusive, including employees who, on the latter date, were ill or on vacation or were or have since been temporarily laid off, but excluding clerical and supervisory employees, timekeepers, assistant foremen, and full-time outside truck drivers engaged in delivering products outside of the plant, and those employees who since December 10, 1938, have resigned or been discharged for cause, to determine whether they desired to be represented by International Association of Machinists, Local #1037, affiliated with the American Federation of Labor, or by United Electrical, Radio and Machine Workers of America, Local No. 1138, affiliated with the Congress of Industrial Organizations, for the purposes of collective bargaining, or by neither. Pursuant to the Direction, as amended, an election by secret ballot was conducted at Hopkins, Minnesota, on September 14, 1939, under the direction and supervision of the Regional Director for the Eight- eenth Region (Minneapolis, Minnesota). Full opportunity was af- forded all parties to the investigation to participate in the conduct of the secret ballot and to make challenges. On September 16, 1939, 114 N. L. R. B. 920. 214 N. L. R. B., No. 79. 763 764 DECISIONS OF NATIONAL LABOR RELATIONS' BOARD the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations' Board Rules and Regulations-Series 2, issued and duly served upon the parties an Election Report on the ballot. In his report the Regional Director certified that the election was fairly and impartially conducted and that the ballots cast were duly and fairly counted under his. supervision, and that there had been filed with him by the tellers statements to that effect. No ob- jections or exceptions to the Election'. Report have been filed by any of the parties.
