On August 1, 1939, the Board amended its Direction of Election by striking therefrom the words "within fifteen (15) days from the date of this Direction" and substituting therefor the words "within thirty (30) days from the date of this Direction." 2 On August 10, 1939, the Board further amended its Direction of Election, as amended, by striking therefrom the words "within thirty (30) days from the date of this Direction" and substituting therefor the words "at such time as the Board may in the future direct." 3 The Board hereby further amends its Direction of Election, as amended, by striking therefrom the words "at such time as the Board may direct" and substituting therefor the words "within ninety (90) days from the date of this Direction." [SAME TITLE SUPPLEMENTAL DECISION AND FOURTH AMENDMENT TO DIRECTION OF ELECTION October 6, 1939 On July 18, 1939, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding, the election to be held within fifteen (15) days from the date of the Direction, under the direction and super- 113 N. On August 1, August 10, and September 27, 1939, the Board amended its Direction of Election with regard to the date on which the election was directed to be held. Independent Union of Confectionery Workers, Local 1, the organ- ization which filed the petition for investigation and certification of representatives, has advised the Board that it requests leave to with- draw its petition, or, in the alternative, that its name be omitted from the ballot. Local 138, International Brotherhood of Teamsters, Chauffeurs, Stablemen and Helpers, American Federation of Labor, the only other labor organization involved, has advised the Board that it desires that an election be held. The. Board hereby denies the request of Independent Union of Confectionery Workers, Local 1, for leave to withdraw the petition and grants its request that its name be omitted from the ballot. The Direction of Election, as amended, is hereby further amended by striking therefrom the words "to determine whether they desire to be represented by Independent Union of Confectionery Workers, Local 1, or by Local 138, International Brotherhood of Teamsters, Chauffeurs, Stablemen and Helpers, affiliated with the American Fed- eration of Labor, for the purposes of collective bargaining, or by neither" and substituting therefor the words "to determine whether or not they desire to be represented by Local 138, International Brotherhood of Teamsters, Chauffeurs, Stablemen and Helpers, affil- iated with the American Federation of Labor, for the purposes of collective bargaining." 15 N.
