ORDER DISMISSING APPEAL
On August 17, 2011, Appellant filed a Notice of Appeal. On
September 24, 2012, Appellant filed a response to a new ground of rejection
contained in the Examiner’s Answer mailed on July 24, 2012. Per 37 C.F.R.
39(b)(2), this response is treated as Appellant exercising their option to
reopen prosecution. Per 37 C.F.R. § 41.39(b)(1), this response is also
treated as a request to withdraw the appeal.

Accordingly, the appeal in this application is dismissed.
