Zimmon v. Somers

Appellate Division of the Supreme Court of New York, First Department
Feb 8, 1996
224 A.D.2d 258 (N.Y. App. Div. 1996)

Opinion

February 8, 1996

Appeal from the Supreme Court, New York County (Robert Lippmann, J.).

The willfulness of plaintiffs' failure to disclose can be inferred from the numerous opportunities they had over a fiveyear period to respond to defendants' demands for disclosure and the absence of an excuse for such failure ( see, Wolford v. Cerrone, 184 A.D.2d 833; Meyer v. Southampton Art Partners, 199 A.D.2d 222).

Concur — Milonas, J.P., Ellerin, Wallach, Kupferman and Williams, JJ.
