An appeal and cross appeal having been taken from a judgment of the Supreme Court, New York County, entered on or about November 30, 2020, and said appeal having been perfected,

And plaintiff-appellant having moved for an order dismissing the cross appeal and rejecting any brief in opposition to the appeal or, in the alternative, giving defendants-respondents one final extended deadline of three days from this Court's order to file their brief in opposition to the appeal,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is ordered that the motion is denied insofar as it seeks to dismiss the cross appeal and to preclude defendants from filing a brief in opposition to the appeal. The motion is granted to the extent of adjourning the appeal to the October 2021 Term of this Court, with no further adjournments to be granted. ENTERED: May 20, 2021
