ESTATES OF DECEDENTS, § 346 — when sale of real estate to pay debts was not warranted. Upon petition of administrator to sell real estate to pay debts, where it appeared that the only two claims filed against estate were disallowed, and there was no showing that personal property was not sufficient to pay costs of administration, held that petition should be dismissed.

Appeal from the Probate Court of Rock Island county; the Hon. FOREST DIZOTELL, Judge, presiding.
Reversed and remanded with directions. Heard in this court at the May term, 1946.
