Appellate Division of the Supreme Court of New York, Second Department
Oct 16, 1939
258 App. Div. 737 (N.Y. App. Div. 1939)

Opinion

October 16, 1939.

Appeal from an order denying defendant's [appellant's] motion to resettle an order of sequestration dated March 21, 1938, dismissed, with fifty dollars costs and disbursements. There is no merit to this appeal. The order, however, is not appealable. ( Bergin v. Anderson, 216 App. Div. 844, and cases cited therein.) Lazansky, P.J., Carswell, Johnston, Adel and Taylor, JJ., concur.
