923 So. 2d 555 (Fla. Dist. Ct. App. 2006)

Opinion

No. 4D05-3295.

March 15, 2006.

Petition for writ of certiorari to the Circuit Court for the Seventeenth Judicial Circuit, Broward County; Miette K. Burnstein, Judge; L.T. Case No. 04-18323 21.

Mitchel Chusid and Allison Kay Grant of Ritter, Chusid, Bivona Cohen, LLP, Boca Raton, for petitioner.

Robert W. Murphy, Fort Lauderdale, and Manuel A. Garcia-Linares of Richman, Greer, Brumbaugh, Mirabito Christenson, P.A., Miami, for respondent.

We grant this petition for writ of certiorari and quash a discovery order requiring Westlake to furnish customer information, to the extent that the order failed to include restrictions against the use of the information in soliciting class action plaintiffs. See Pioneer Elecs. (USA), Inc. v. Risi, 918 So.2d 448 (Fla. 4th DCA 2006); Stewart v. Jones, 708 So.2d 996 (Fla. 4th DCA 1998). In all other respects, the petition is denied.

STONE, WARNER and SHAHOOD, JJ., concur.
