West v. State

District Court of Appeal of Florida, Fifth District
Nov 26, 1986
497 So. 2d 1347 (Fla. Dist. Ct. App. 1986)

Opinion

No. 86-860.

November 26, 1986.

Appeal from the Circuit Court, Putnam County, E.L. Eastmoore, J.

James B. Gibson, Public Defender, and Kenneth Witts, Asst. Public Defender, Daytona Beach, for appellant.

Jim Smith, Atty. Gen., Tallahassee, and Sean Daly, Asst. Atty. Gen., Daytona Beach, for appellee.

This is an appeal from a sentence where the sentencing judge failed to give proper credit for time served while awaiting trial. Appellant received such credit only as to one of three concurrent sentences. He should have been given credit on all three. Daniels v. State, 491 So.2d 543 (Fla. 1986).

SENTENCE QUASHED, REMANDED.

ORFINGER and COWART, JJ., concur.
