Court of Appeals of Texas, Fifth District, Dallas
Sep 10, 2008
No. 05-08-00511-CV (Tex. App. Sep. 10, 2008)

Opinion

No. 05-08-00511-CV

opinion issued September 10, 2008.

On Appeal from the 194th Judicial District Court Dallas County, Texas, Trial Court Cause No. F06-89636-M.

Before Justices WRIGHT BRIDGES, and MAZZANT.

MEMORANDUM OPINION

Appellants appealed the trial court's judgment in this bond forfeiture case. The trial judge signed the judgment on January 16, 2008. Appellants filed an untimely motion for new trial on February 19, 2008, which made their March 31, 2008 notice of appeal untimely. See Tex. R. Civ. P. 5; Tex. R. App. P. 26.1(a). Absent a timely notice of appeal, we have no jurisdiction. Accordingly, we dismiss the appeal for want of jurisdiction. PER CURIAM 080511F.P05

Appellants did not respond to our August 6, 2008 letter seeking briefs addressing our jurisdiction over the appeal.
