RAYMOND WEBER, Appellant v. THE STATE OF TEXAS, Appellee

From the County Court at Law Walker County, Texas
Trial Court No. 15-0773

ORDER

Appellant's "Motion to Extented Time for Rehearing Oral Argument Requested During Rehearing" was filed on August 7, 2017. The motion to extend the time to file appellant's motion for rehearing is granted. Appellant's motion for rehearing is due September 7, 2017. Appellant's request for oral argument is denied.

After counsel has been permitted to withdraw in an Anders appeal, the appellant is no longer represented by counsel and may file a motion for rehearing or other motions on his own behalf without violating the prohibition on hybrid representation. See Scott v. State, 301 S.W.3d 700, 701 (Tex. App.—Waco 2009, op. on rhg).

We note that these motions were not served on the opposing party as required by the Rules of Appellate Procedure. See TEX. R. APP. P. 9.5. Appellant has previously served documents sent to this Court; thus, this is not an unknown or new requirement to him. For these motions only, however, we use Rule 2 so that we may expedite a decision on the motions. TEX. R. APP. P. 2. Appellant is warned that the Court will not grant any other motions or requests for relief or other actions if the document has not been properly served.

PER CURIAM Before Chief Justice Gray, Justice Davis, and Justice Scoggins
Motion for extension of time granted
Motion for oral argument denied
Order issued and filed August 16, 2017
