JERRY D. WEBB, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Elizabeth A. Copeland Judge.

This case is calendared for trial at the Kansas City, Missouri Trial Session of the Court scheduled to commence on October 2, 2023.

On June 9, 2023, respondent filed with the Court a Motion to Dismiss for Lack of Prosecution. On June 22, 2023, the Court issued an Order to Show Cause asking for a response from petitioner as to why this case should not be dismissed for lack of prosecution. On September 18, 2023, petitioner filed with the Court a document titled "Stipulation of Facts" (Index No. 13). It appears to the Court to more properly be a response to the Court's Order to Show Cause.

Upon due consideration, and for cause, it is

ORDERED that petitioner's Stipulation of Facts (Index No. 13) be retitled as Petitioner's Response to Order to Show Cause.
