The reporter's record in this appeal is incomplete. Missing are records from seven proceedings held between November 5, 2021 and April 28, 2023. The records have not been filed pending appellant's payment of the reporter's fees.
By order of September 19, 2023, appellant was to provide, no later than October 5, 2023, written verification he had paid or made arrangements to pay the fees. On October 11, 2023, at appellant's request, we extended the deadline to November 2, 2023. Before the Court now is appellant's November 2, 2023 amended motion for another extension. Appellant asserts in the motion that a money order he sent certified mail, return receipt requested with respect to one of the records has not been delivered. He further asserts court reporter Terri Etekochay has not provided him with "the breakdown of costs" for each of the remaining five records; she has provided him only the total cost. Appellant asks we extend the time to pay for the records to December 2, 2023.
We note that our September 19th and October 5th orders cautioned that we would not extend any deadlines absent exigent circumstances as the record was first due May 17, 2023. While we are sympathetic to appellant's circumstances, the appeal must move forward. Accordingly, we DENY appellant's motion.
The record for any of the proceedings for which payment is received remains due November 30, 2023, and appellant's brief shall be filed no later than January 3, 2024.
We DIRECT the Clerk of the Court to send appellant a copy of the Court's "Information for People without Lawyers" handout. We further DIRECT the Clerk of the Court to send a copy of this order to Ms. Etekochay; substitute reporter Norma Rico; and the parties.
