Vargo v. Carter

Supreme Court of Florida
May 10, 1967
198 So. 2d 635 (Fla. 1967)

Opinion

No. 35670.

May 10, 1967.

Writ of Certiorari to the District Court of Appeal, Fourth District, 188 So.2d 402.

Rose Marlow, Miami, for petitioner.

Fleming, O'Bryan Fleming and Norman C. Roettger, Jr., Fort Lauderdale, for respondent.

The petition for certiorari reflected probable jurisdiction in this court so we issued the writ. However, after hearing argument and considering further the briefs and record in this cause we have determined that the writ was improvidently issued. The writ of certiorari heretofore issued is discharged and the petition for writ of certiorari is dismissed.

It is so ordered.

THORNAL, C.J., and THOMAS, DREW, O'CONNELL and CALDWELL, JJ., concur.
