Jul 12, 1978
360 So. 2d 802 (Fla. Dist. Ct. App. 1978)

Opinion

No. 77-1794.

July 12, 1978.

Appeal from the Circuit Court for Collier County; James R. Thompson, Judge.

Jack O. Johnson, Public Defender, Bartow, and Douglas A. Wallace, Asst. Public Defender, Bradenton, for appellant.

Robert L. Shevin, Atty. Gen., Tallahassee, and Richard G. Pippinger, Asst. Atty. Gen., Tampa, for appellee.

We affirm the judgment of the trial court. However, the present sentence contains the phrase "hard labor" which is improper. Knight v. State, 349 So.2d 232 (Fla.2d DCA 1977). We remand the case for correction of sentence. Appellant need not be present at that time.

HOBSON, Acting C.J., and BOARDMAN and OTT, JJ., concur.
