Opinion
Gen. No. 9,428. (Abstract of Decision.)
Opinion filed May 24, 1944
BROKERS, § 69 — completion of sale negotiations by seller or second broker as not depriving first broker of commission. Where suit was brought to collect a real estate broker's commission, and evidence showed that after plaintiff had procured buyer for farm belonging to defendant and other heirs of an estate the deal was consummated by a second broker, held that, where a broker is employed by a seller to find a purchaser and through his efforts the seller is brought into communication with the purchaser, the broker cannot be deprived of his commission because the seller takes up and completes the negotiations himself or through another broker, even though the seller accepts the purchaser under different terms, prices or conditions.
