TIMOTHY KAYLON VALDEZ, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 291st Judicial District Court Dallas County, Texas, Trial Court Cause No. F21-75126-U

ORDER

DENNISE GARCIA JUSTICE.

Before the Court is court reporter Sasha S. Brooks's third request for an extension of time to file the reporter's record.

The record was originally due January 2, 2023. On January 5, 2023, we notified Ms. Brooks by postcard that the record was overdue and directed her to file the record within thirty days, that is, by Monday, February 6, 2023. See Tex. R. App. P. 4.1(a). On February 8, 2023, Ms. Brooks filed a request for a thirty-day extension to file the record "due to workload," which we granted on February 9, 2023, ordering that the record was due March 10, 2023. On March 16, 2023, Ms Brooks filed a second request for a thirty-day extension "due to workload." We granted the motion and ordered the reporter's record was due April 17, 2023. On April 25, 2023, when the reporter's record had not been filed, we ordered Ms. Brooks to file the reporter's record by May 10, 2023, and we cautioned her that the failure to file the reporter's record by that date could result in her being ordered not to sit as a court reporter until the record is filed. Also on April 25, 2023, Ms. Brooks filed her third request for extension seeking a 7-day extension because her laptop had crashed the previous week.

We DENY Ms. Brooks's third request for an extension. The reporter's record is due MAY 10, 2023. As we stated in our order of April 25, 2023, the failure to file the record by May 10, 2023, will result in the Court utilizing whatever remedies it has available, which may include ordering that Ms. Brooks not sit as a court reporter until she files the complete reporter's record in this appeal.
