ORDER

Maurice B. Foley Judge.

On September 29, 2023, respondent filed a Motion to Dismiss for Failure to Properly Prosecute moving that the Court dismiss this case and enter a decision in the amount as set forth in the notice of deficiency relating to 2018.

This case was called from the calendar of the Court's San Francisco, California trial session on October 23, 2023. There was no appearance by or on behalf of the petitioner. Counsel for respondent appeared and was heard. At calendar call, respondent asked the Court to deny the Motion to Dismiss for Failure to Properly Prosecute, filed September 29, 2023, on the ground that the parties will continue to work together to reach a settlement. Upon due consideration and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute, filed September 29, 2023, is denied. It is further

ORDERED that this case is continued, and jurisdiction of this case is retained by the undersigned. It is further

ORDERED that, on or before November 22, 2023, the parties shall file a Proposed Stipulated Decision or a joint Status Report as to the then-present status of this case.
