ORDER MODIFYING CONDITIONS OF SUPERVISED RELEASE


The above entitled matter came before the Court on March 30, 2004, for a hearing on the Defendant's Motion to Modify the Conditions of his release. The Court being fully advised in the matter by counsel for both parties and having consulted with the United States Probation Office, hereby enters the following,

ORDER

1. The Court's prior order requiring the Defendant to reside in the Cornell Community Corrections facility is suspended indefinitely for a period not to exceed four months from the dale hereof to allow the Defendant time to complete a scheduled surgery at the University of Utah Hospital and to allow time for the Defendant's recovery from the surgical procedure.

2. All other provisions of the Defendant's supervised release shall remain in effect.

3. The Defendant's obligation to complete the remaining portion of the 120 days previously imposed at Cornell shall be reinstated on July 30, 2004, or at such earlier time that the Defendant's probation officer advises the Court, and the parties, that the Defendant has sufficiently recovered to again reside at Cornell.

4. The Defendant is ordered to keep the United States Probation Office regularly apprised of his medical condition during the suspension period.

5. For calculation purposes, the Court finds that Mr. Wyatt began his term at Cornell on February 6, 2004.
