ORDER

In response to the court's order of April 5, 2004, defendant Charmayne Cook has filed an affidavit in which she avers that her retained trial counsel, Phillip Steans, misled her when he talked her into entering into a plea agreement with the government. She contends that she did not enter her plea of guilty knowingly and intentionally.

The government may have until June 9, 2004, in which to file and serve a brief setting forth its position on the question whether an evidentiary hearing is required to resolve defendant's post conviction motion. If defendant wishes, she may file and serve a response to the government's brief no later than June 30, 2004.

BY THE COURT.
