RULING

This matter was referred to United States Magistrate Judge Patrick Hanna for Report and Recommendation. After an independent review of the record, including the Objections filed by the defendant, this Court concludes that the Report and Recommendation of the Magistrate Judge is correct and adopts the findings and conclusions therein as its own. As such, it is hereby ORDERED:

The Motion to Dismiss is DENIED at this time, without prejudice to the right of the defendant to re-urge the motion following completion of the presentation of evidence.
