ORDER
PER CURIAM
This is an interlocutory appeal from an order denying appellant's motion to compel arbitration signed October 9, 2023. See Tex. Civ. Prac. & Rem. Code §§ 51.016, 171.098. On October 30, 2023, appellant filed a motion to stay trial court proceedings pending resolution of this appeal. See Tex. R. App. P. 29.3
We GRANT in PART appellant's motion stay to stay the trial court proceedings as to the claims between TRS Constructions, Inc. and:
- CLA Gleannloch, LLC
- Gleannloch CLA Partners, Ltd.
- Freddy Cabrera-Meneses d/b/a 5 Elements Service
- DML HVAC, Inc.
- Jayco Construction, LLC
- Porter Glass & Mirror, Inc.
- Felipe Rodriguez d/b/a Madero Rodriguez Construction
- Houston Stork Plumbing Services, LLC
- Zen Construction, LLC
Additionally, we stay the counterclaims filed by CLA Gleannloch, LLC and Gleannloch CLA Partners, Ltd. against
- TRS Constructions, Inc
- Freddy Cabrera-Meneses d/b/a 5 Elements Service
- DML HVAC, Inc.
- Jayco Construction, LLC
- Porter Glass & Mirror, Inc.
- Felipe Rodriguez d/b/a Madero Rodriguez Construction
- Houston Stork Plumbing Services
- Zen Construction, LLC
We order all proceedings in the trial court between the above listed parties STAYED until after a final decision by this court in this interlocutory appeal, or until further order of this court.
It is further ordered that the stay is not granted as to the claims between CLA Gleannloch, LLC and Gleannloch CLA Partners, Ltd. and:
- Progressive Services, Inc.
- CASCO Architectural and Engineering and CASCO Diversified Corporation d/b/a CASCO Architectural and Engineering
- CEI Engineering Associates, Inc.
- Wright Consulting Engineers of Arizona, LLC d/b/a Wright Structural Engineers
- Reliance Building Systems, LLC.
Appellant further requested that we stay the arbitration proceedings pending this appeal, that portion of the motion is DENIED.
