Appeal, No. 83, Oct. T., 1936, by respondent, from judgment of C.P. No. 4, Phila. Co., June T., 1934, No. 4971, in case of Philoty A. Tenaglia v. Sarah A. Tenaglia.

Before KELLER, P.J., CUNNINGHAM, BALDRIGE, STADTFELD, PARKER, JAMES and RHODES, JJ. Decree affirmed.

Libel in divorce a.v.m.

Report filed by master recommending decree of divorce on ground of desertion. Exceptions to report dismissed and report approved, opinion by FINLETTER, P.J., and final decree entered. Respondent appealed.

Error assigned, among others, was dismissal of exceptions to master's report.

Argued November 17, 1936.


Upon a review of the evidence in this case we are in general accord with the conclusions of the Master and the Court below. Since the argument the appellant has died. We shall decide the case — see Upperman v. Upperman, 119 Pa. Super. 341 — but no good purpose would be served by a review of the evidence.

The decree is affirmed.
