Summers v. State

Supreme Court of Delaware
Jul 1, 2010
998 A.2d 852 (Del. 2010)

Opinion

No. 196,2010.

July 1, 2010.

Court Below-Superior Court of the State of Delaware, in and for Kent County, Cr. ID 9704012286.

Before STEELE, Chief Justice, HOLLAND and BERGER, Justices.

ORDER

This first day of July 2010, after careful consideration of appellant's opening brief and the State's motion to affirm, we find it manifest that the judgment below should be affirmed on the basis of the Superior Court's well-reasoned decision dated March 12, 2010. The Superior Court did not err in concluding that appellant's fifth motion for postconviction relief was time-barred, that his claims were otherwise procedurally barred, and that appellant had failed to overcome the procedural hurdles.

NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED.
