Judgment and order affirmed, with costs. All concur, except Crosby, J., who dissents and votes for reversal on the law and for dismissal of the complaint on the ground that by the terms of the application itself there was no insurance unless the policy was actually issued. (The judgment awards recovery upon two life insurance policies. The order denies a motion for a new trial on the minutes.)
