ORDER OF AFFIRMANCE

This is a proper person appeal from a district court order denying a petition for a writ of mandamus or declaratory relief. Sixth Judicial District Court, Pershing County; Michael Montero, Judge.

Having considered appellant's civil proper person appeal statement, respondent's response, appellant's reply, and the record on appeal, we conclude that the district court did not err by dismissing appellant's action. In particular, because appellant's petition was based on his contention that respondent failed to act in accordance with the established standards relating to parole, it was precluded by NRS 213.10705, which specifically provides that the “establishment of standards” relating to parole is not intended to create any basis for a cause of action against the state or its agencies.

We grant appellant's proper person motion to file a reply brief and direct the clerk of this court to file appellant's reply brief provisionally received by this court on February 22, 2012.


Accordingly, we

ORDER the judgment of the district court AFFIRMED.
