On the authority of Palmer v. State, No. 4D00-2748, ___ So.2d ___, 2000 WL 1872703 (Fla. 4th DCA Dec. 27, 2000), we (1) treat this petition for writ of mandamus as one for certiorari, (2) grant the petition, and, (3) remand for attorney Alan Levine to file his notice of appearance. If the state challenges the propriety of the representation, a judge other than Judge Goldstein shall rule on the issues raised by the state.
