ORDER

On December 14, 2007, plaintiff filed her ERISA complaint with this court. When no certificate of service or response from defendants had been filed two months later, this court set this case for a telephonic status and preliminary pretrial conference so that we could get it moving. Plaintiff was alerted to this conference on or about February 14, 2008. On the appointed date, March 13, 2008, at 9:00 a.m., plaintiff's attorney did not call the court. The court called plaintiff's attorney's office and they located him on his cell phone. Plaintiff explained that there had been some confusion about service, so that defendant still had not been served.

The court advised counsel that if he does not serve his complaint within the time allotted by the rule — here by April 14, 2008 — then this court will dismiss this lawsuit. This is one of the fastest-moving federal courts in America. The court expects all parties who invoke the court's jurisdiction to comport themselves accordingly.
