STATE OF LOUISIANA v. DONOVAN WRIGHT


In Re: Donovan Wright, applying for supervisory writs, 32nd Judicial District Court, Parish of Terrebonne, No. 742992.

BEFORE: THERIOT, PENZATO, AND GREENE, JJ.

WRIT DENIED IN PART AND GRANTED IN PART. This application appears to be a Motion for Summary Judgment filed in this court in the first instance. Because there is no indication the motion has been filed in the district court, this writ presents nothing for this court to review. Furthermore, relator's Petition for Damages filed on or about September 5, 2023, naming District Attorney Joseph L. Waitz, Jr. as the defendant is civil in nature and should be processed in accordance with the Louisiana Code of Civil Procedure. See La. Code Civ. P. art. 891. Accordingly, the September 14, 2023, ruling denying the Petition for Damages is vacated, and this matter is remanded to the district court to process under the court's civil docket.
