. Appellant's petition for review is allowed. The decision of the Court of Appeals is vacated, and this case is remanded to the Court of Appeals for reconsideration in light of State v. Leistiko, 352 Or. 172, 282 P.3d 857 (2012), modified on recons, 352 Or. 622, 292 P.3d 522 (2012). Motion to reactivate is moot.
