APPEAL FROM THE FIRST CIRCUIT COURT (CR. NO. 98-2238)

Richard D. Gronna, for the appellant-defendant Angel Inoue, on the writ

MOON, C.J., LEVINSON, NAKAYAMA, RAMIL, and ACOBA, JJ.

ORDER DISMISSING APPLICATION FOR WRIT OF CERTIORARI

Upon consideration of the application for writ of certiorari filed by Defendant-Appellant Angel Inoue and the record, it appears (1) the Intermediate Court of Appeals filed its summary disposition order and an order amending the summary disposition order on May 14, 2002, (2) Defendant-Appellant Angel Inoue filed his application for writ of certiorari on June 14, 2002, and (3) the application is untimely and we lack jurisdiction to consideration. See HRS § 602-59(c); Cf. Korsak v. Hawaii Permanente Medical Group, Inc., 94 Hawai`i 297, 300, 12 P.3d 1238, 1241 (2000) (dismissing Special Compensation Fund's application for writ of certiorari for lack of jurisdiction where the application was untimely); State v. Bolosan, 78 Hawai`i 86, 88 n. 4., 890 P.2d 673, 675 n. 4. (1995) (dismissed State's application for writ of certiorari as untimely). Therefore,

IT IS HEREBY ORDERED that Defendant-Appellant Angel Inoue's application for writ of certiorari is dismissed.
