Opinion

Writ granted. For the reasons assigned by Judge Lobrano, the trial court abused its discretion in finding actual prejudice without sufficient evidence to support that finding. Accordingly, we reverse and vacate the lower courts' rulings, deny the defendant's motion for mistrial, and remand the case to the District Court for further proceedings.
