STATE OF LOUISIANA v. ANDREW HARVEY, JR.


Andrew Harvey, Jr., applying for supervisory writs, 21st Judicial District Court, Parish of Tangipahoa, No. 801966.

BEFORE: THERIOT, PENZATO, AND GREENE, JJ.

WRIT DENIED. The Ramos jury unanimity rule does not apply retroactively in Louisiana. See State v. Reddick, 2021-01893 (La. 10/21/22), 351 So.3d 273, 274. Therefore, the district court did not abuse its discretion by denying relator's untimely application for postconviction relief or by not holding an evidentiary hearing. See La. Code Crim. P. arts. 930.2 & 930.8(A).
