Opinion

62 N.W.2d 914 (Iowa 1954) STATE of Iowa, Appellee, v. Donald Charles FITTERER, Appellant. No. 48474. Supreme Court of Iowa. March 9, 1954

Appeal from Lee District Court; J. R. Leary, Judge.

Joseph L. Phelan, Fort Madison, for appellant.

Leo A. Hoegh, Atty. Gen. of Iowa, R. R. R. Dvorak, Asst. Atty. Gen., Robert N. Johnson, County Attorney, Fort Madison, for appellee.

       PER CURIAM.

The appeal is presented on a clerk's transcript of the record. We have carefully examined it and find no reversible error in the record. The judgment of the court, in accord with the verdict of the jury, finding and adjudging defendant, Donald Charles Fitterer, guilty of the crime of murder in the first degree in violation of Section 690.2 of the Iowa Code of 1950, I.C.A., and sentencing and committing him to the Iowa State Penitentiary at Fort Madison, Iowa, for the term of his natural life at hard labor and ordering him to pay the costs of his prosecution, is therefore affirmed.

       Affirmed.
