State v. Duplantis

Supreme Court of Louisiana
Feb 9, 1979
367 So. 2d 858 (La. 1979)

Opinion

No. 60856.

February 9, 1979.

APPEAL FROM 24TH JUDICIAL DISTRICT COURT, PARISH OF JEFFERSON, STATE OF LOUISIANA, HONORABLE WALLACE C. LeBRUN, J.

Wayne A. Mancuso, Metairie, for defendant-appellant.

William J. Guste, Jr., Atty. Gen., Barbara Rutledge, Asst. Atty. Gen., John M. Mamoulides, Dist. Atty., Abbott J. Reeves, Roy F. Blondeau, Jr., Asst. Dist. Attys., for plaintiff-appellee.

The issue of whether defendant was denied effective assistance of counsel is more properly raised by application for writ of habeas corpus at which time a full evidentiary hearing can be conducted. State v. Anthony, 347 So.2d 483 (La. 1977); State v. Ross, 343 So.2d 722 (La. 1977); State v. Mouton, 327 So.2d 413 (La. 1976).

Finding no reversible error based on the record before us, defendant's conviction and sentence are affirmed.

BLANCHE, J., does not participate.
