Motion for Postconviction Relief


Dear Mr. Downes:

Your second motion for postconviction relief is denied. The claims raised in your second motion could have been raised in your first motion for postconviction relief, but were not. Therefore, your claims are barred. Mundy v. State, 788 A.2d 131 (Del. 2001).

Obviously, to the extent that you raised the same claims in both motions, they were denied in my decision dated March 10, 2003.

IT IS SO ORDERED.
