State v. Daise

District Court of Appeal of Florida, Third District
Jun 26, 1984
451 So. 2d 1032 (Fla. Dist. Ct. App. 1984)

Opinion

No. 83-2253.

June 26, 1984.

Appeal from Circuit Court, Dade County; George Orr, Judge.

Jim Smith, Atty. Gen. and Diane Leeds, Asst. Atty. Gen., for appellant.

Joe Lang Kershaw, Jr., Miami, for appellee.

Before BARKDULL, BASKIN and FERGUSON, JJ.

The state appeals the trial court's order granting defendant Daise a mistrial and a new trial. We affirm upon a finding that the record fails to disclose any clear abuse of discretion by the trial court. See State v. Woodson, 330 So.2d 152 (Fla. 4th DCA 1976); Jones v. State, 233 So.2d 432 (Fla. 3d DCA 1970); Hanson v. State, 187 So.2d 54 (Fla. 3d DCA 1966).
