STATE of Missouri, Respondent, v. Brandon COX, Appellant.

Michel A. Trapasso, for Respondent. David A. Bruns, St Louis, for Appellant.

Michel A. Trapasso, for Respondent.

David A. Bruns, St Louis, for Appellant.

Division Three: Edward R. Ardini, Jr., Presiding Judge, Mark D. Pfeiffer, Judge and W. Douglas Thomson, Judge

ORDER

PER CURIAM:

Brandon Cox appeals the judgment of his convictions, following a jury trial, for first-degree murder and armed criminal action. On appeal, Cox asserts the trial court: (1) erred in overruling his motions for judgment of acquittal and for new trial because there was insufficient evidence to prove the element of deliberation beyond a reasonable doubt to support a conviction of first-degree murder; and (2) abused its discretion in failing to, sua sponte, take curative action regarding the State's improper remarks during closing argument. We affirm. Because a published opinion would have no precedential value, we have provided an unpublished memorandum to the parties which sets forth the reasons for this order. Rule 30.25(b).
